FWO Cracks Down on Food Outlets Now

The Fair Work Ombudsman (FWO) recently carried out surprise inspections of 45 fast food outlets, restaurants, and cafés across Sydney, Brisbane, Canberra, and Cairns. These checks targeted payslip and record-keeping obligations — a critical focus area given that this sector accounted for 25% of all Compliance Notices in 2023–24 and saw over $5.6 million recovered for underpaid workers.

FWO inspectors are particularly concerned about industries employing large numbers of young people and migrant workers, who may not be aware of their workplace rights. Missing or inaccurate records are one of the most common signs of underpayment, and employers who fail to comply risk fines of up to $1,890 per individual breach and $9,900 per organisational breach, alongside orders to backpay wages.

Last year, a food operator received a record penalty of more than $15 million for underpaying migrant workers, sending a strong message to the industry: compliance is non-negotiable.
